Envitely – Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Envitely platform, websites, applications, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms.

1. About Envitely

Envitely is operated by Envitely Ltd, a company based in the United Kingdom (“Envitely”, “we”, “us”, or “our”).

The Service is made available globally to individuals and organisations for the planning, management, and participation in events.

2. Eligibility and Accounts

2.1 You must be at least 18 years old to create an account.

2.2 Accounts may be created by:

  – Individuals acting in a personal capacity; or

  – Organisations, acting through authorised users.

2.3 Where an account is created on behalf of an organisation, that organisation is responsible for:

  – All activity conducted under the account;

  – Compliance by its collaborators and users with these Terms.

2.4 You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account.

3. User Roles and Access

3.1 The Service supports different user roles, including:

  – Planners, who create and manage events; and

  – Attendees, who participate in events created by others.

3.2 All account holders may attend events and receive event-related notifications.

3.3 Access to features may vary depending on your subscription plan.

4. Free and Paid Plans

4.1 Envitely offers a free plan with limited functionality, which may include limits on:

  – Number of guests;

  – Number of collaborators;

  – Number of active events; and

  – Level of support.

4.2 Paid subscriptions provide access to additional features and higher limits.

4.3 We reserve the right to modify plan features and limits at any time. Any material changes to paid plans will be communicated in advance where required.

5. Subscriptions, Billing, and Cancellation

5.1 All paid plans are annual subscriptions.

5.2 Annual subscriptions may be paid:

  – Monthly (annual commitment); or

  – Annually in advance (at a discounted rate).

5.3 Payments are processed via a third-party payment processor. Envitely does not store full payment card details.

5.4 You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

5.5 No refunds or credits are provided for:

  – Unused subscription periods;

  – Downgrades;

  – Account termination; or

  – Early cancellation.

5.6 If payment fails or is reversed, we may suspend or terminate access to the Service.

6. Events and User Content

6.1 Users may create events and upload content, including:

  – Text, images, documents, links;

  – Guest information; and

  – Event-related materials (“User Content”).

6.2 You retain ownership of your User Content. By using the Service, you grant Envitely a limited, non-exclusive licence to host, process, and display such content solely for the purpose of providing the Service.

6.3 You are solely responsible for:

  – The accuracy and legality of User Content;

  – Ensuring you have the right to upload and use third-party personal data (including guest data);

  – Compliance with applicable laws relating to events and communications.

6.4 Envitely does not review or endorse events or User Content and is not responsible for events organised through the Service.

7. Communications

7.1 Users cannot use Envitely to send marketing or bulk emails.

7.2 Envitely may send service-related communications, including:

  – Event invitations;

  – Event updates or changes;

  – System notifications.

7.3 Marketing communications will only be sent where a user has explicitly opted in and may be withdrawn at any time.

8. Acceptable Use

You must not:

  – Use the Service for unlawful, harmful, or misleading activities;

  – Upload content that infringes intellectual property or privacy rights;

  – Attempt to disrupt, reverse engineer, or misuse the Service;

  – Use the Service to send unsolicited communications.

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Suspension and Termination

9.1 We may suspend or terminate access to the Service:

  – For breach of these Terms;

  – For misuse of the Service;

– Where required by law.

9.2 Termination does not entitle you to a refund.

10. Availability and Changes

10.1 The Service is provided on an “as is” and “as available” basis.

10.2 We do not guarantee uninterrupted or error-free operation.

10.3 We may update or modify the Service at any time.

11. Limitation of Liability

11.1 To the maximum extent permitted by law, Envitely shall not be liable for:

  – Loss of profits, revenue, or business;

  – Loss of data;

  – Indirect or consequential damages.

11.2 Our total liability in connection with the Service shall not exceed the amount paid by you to Envitely in the 12 months preceding the claim.

11.3 Nothing in these Terms limits liability for death or personal injury caused by negligence or for fraud.

12. Governing Law and Jurisdiction

12.1 These Terms are governed by the laws of England and Wales.

12.2 The courts of England and Wales shall have exclusive jurisdiction.

12.3 Nothing in these Terms affects mandatory consumer rights under applicable local laws.
